When rental properties are infested by pests, it can start a debate about whose responsibility it is to address the problem. More often than not, it falls on the landlord to ensure a rental property is kept pest-free.

There are circumstances when a tenant may be liable for pest control costs, which is why there is often conflict between parties when uncertainty exists about what caused the pests.

Important: Regardless of responsibility, address pest problems immediately due to potential health threats. Increasing pest appearances usually means many more are lurking unseen.

Landlord Responsibilities

Typically, landlords are responsible for providing a clean and habitable home when a lease starts and maintaining general pest control throughout the lease.

Comply with habitability standards and local building codes
Provide or enlist pest control services for regular preventative measures
Educate tenants on minimizing pest likelihood
React to pest reports as soon as notified
Communicate severity and coordinate appropriate treatment

Steps When Tenant Reports Pests

5Check lease agreement for financial responsibility
6Accept responsibility or invoice tenant if at fault

Document Everything: Note when complaints come in, actions taken, remedies provided, invoices, exterminator notes, and all correspondence to protect against legal problems.

Pest Control Clauses in Lease Agreements

Include a section in the lease that outlines each party's responsibilities to avoid disputes. Many local laws allow tenants to be made financially responsible if they:

Introduced Pests

Brought in used, infested furnishings (bed bugs, fleas, etc.)

Gross Negligence

Failed to maintain a clean environment, attracting pests through filth

Regular Pest Control: May not be mandated by law, but quarterly or bimonthly treatments help prevent termites, cockroaches, ants, etc. The lease should clearly dictate who is responsible.

Even though landlords are responsible for pest management, tenants have duties too:

Maintain clean environment free of trash, food waste, clutter
Treat pets with appropriate flea and tick medications
Avoid introducing pests via infested secondhand furniture or luggage
Report potential access points that may allow pests inside
Report leaks that may create breeding grounds

Steps When Pests Are Found

Report signs of pests, activity, or damage to landlord immediately
Allow time for landlord to arrange inspection and treatment
Check lease agreement for responsibility
Implement DIY pest control or hire service if landlord fails to act

Tenant Rights When Landlord Fails to Act

If a landlord fails to provide pest control when a complaint is made and the tenant is not at fault, tenants typically have these recourses (depending on local laws):

Withhold Rent

Tenants can usually hold rent until property is habitable. Stop paying since uninterrupted enjoyment is no longer provided.

Break the Lease

In severe cases not caused by tenant, the lease is void if habitable environment is not provided with no remedy in sight.

Relocate Temporarily

If home is uninhabitable, relocate at landlord's expense. Costs can be deducted from following month's rent.

Who Pays for Pest Control?

The law mentions an "implied warranty of habitability": landlords must provide and maintain a clean, pest-free property meeting local standards. Pest infestations violate those standards, making landlords responsible.
